These Terms are the agreement between you and SproutKid for using our website, app, and AI companion service. Please read them carefully. By creating an account, subscribing, or using SproutKid, you agree to these Terms.

1. Who we are

SproutKid is operated by TomicSwissTech, a sole proprietorship established in St. Margrethen, Canton of St. Gallen, Switzerland (Swiss business identification number CHE-192.510.580). You can contact us at support@sproutkid.ai.

3. What SproutKid is — and what it is not

SproutKid is an AI companion that answers questions, helps with homework, and chats, with safety filtering applied to every message. Responses are generated by artificial intelligence and may be inaccurate, incomplete, or out of date. SproutKid is not a substitute for a teacher, doctor, therapist, lawyer, or other professional, and it is not a counselling or emergency service. If your child may be in danger or in crisis, contact a trusted adult and your local emergency services immediately. You should review important information independently and not rely on SproutKid for decisions that require professional advice.

4. Your account

Keep your login details secure and do not share them. You are responsible for activity that happens under your account, including your child's use. Tell us promptly at support@sproutkid.ai if you believe your account has been accessed without permission. You can set an optional 4-digit PIN on a child profile for an extra layer of control.

5. Subscription, billing, and renewal

6. Right of withdrawal and refunds

If you are a consumer in Switzerland or the EU/EEA, you may have a statutory right to withdraw from a distance contract within 14 days. Because SproutKid is a digital service that begins immediately, by subscribing and starting to use it you ask us to begin the service during this period and acknowledge that your right of withdrawal ends once the service has been fully provided. Outside of mandatory legal rights, subscription fees are generally non-refundable, but if something has gone wrong, contact support@sproutkid.ai and we will try to make it right.

When using SproutKid, you and your child agree not to:

We may suspend or terminate access that breaches these Terms or that we reasonably believe puts a child or others at risk.

8. Safety filtering

SproutKid applies automated filtering and moderation to messages and responses and is designed to block sexual and violent content. No automated system is perfect, and we cannot guarantee that every unwanted output will be caught or that every safe message will get through. Please supervise your child's use and report problems to support@sproutkid.ai so we can improve.

9. Intellectual property

SproutKid, including its name, design, website, app, and content we provide, is owned by TomicSwissTech or its licensors and is protected by law. We grant you a limited, personal, non-transferable, non-exclusive right to use SproutKid for your household while your subscription is active. You may not copy, modify, distribute, or create derivative works from the service except as allowed by law.

Our Privacy Policy and Children's Privacy page explain how we handle personal data. By using SproutKid you acknowledge those documents.

11. Disclaimers

To the fullest extent permitted by law, SproutKid is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. This does not exclude any rights you have as a consumer that cannot be excluded under applicable law.

12. Limitation of liability

To the fullest extent permitted by law, SproutKid and TomicSwissTech are not liable for indirect, incidental, special, or consequential damages, or for loss of data or profits, arising from your use of the service. Nothing in these Terms limits liability that cannot be limited by law (including liability for death or personal injury caused by negligence, or for intent or gross negligence). Where our liability is permitted to be limited, our total liability for any claim relating to the service is limited to the amount you paid us for the service in the 12 months before the claim.

13. Suspension and termination

You may stop using SproutKid and delete your account at any time from inside the app. We may suspend or end your access if you breach these Terms, if required by law, or to protect users; where reasonable, we will give notice. If we end your subscription other than for breach, we will refund any prepaid period that you were unable to use.

14. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will notify the account's parent/guardian. Continuing to use SproutKid after a change takes effect means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of Switzerland, and the courts of the Canton of St. Gallen have jurisdiction, except where mandatory consumer-protection law in your country of residence gives you the right to rely on your local law and courts. Nothing here removes those mandatory rights.
